Agreement and scope
The website at madebyanvil.com (the "Site") is owned and operated by Anvil, LLC ("Anvil," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
These Terms govern the public Site, including its portfolio, case studies, project inquiry form, and other content. They do not govern design, development, hosting, consulting, or other client services. Those services are governed by a separate written agreement between Anvil and the client.
If you use the Site on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.
Using the site
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Site for lawful informational and business purposes.
You may not:
- use the Site in violation of law or another person's rights;
- interfere with the Site's operation, security, or availability;
- attempt to gain unauthorized access to the Site, its systems, or related accounts;
- submit malicious code, deceptive inquiries, spam, or unlawful material;
- scrape or use automated means to access the Site in a way that burdens its systems; or
- copy, republish, sell, or commercially exploit Site content without permission.
We may change, suspend, or discontinue any part of the Site at any time. We do not promise that every feature or piece of content will remain available.
Ownership and permitted use
The Site's design, code, text, graphics, logos, and other content are owned by Anvil or used with permission and are protected by intellectual-property laws. Client names, trademarks, photography, and work shown in case studies may belong to the applicable client or other credited owner.
You may view the Site and share links to its public pages. You may not reproduce or adapt a substantial part of the Site for publication, resale, training a competing service, or another commercial purpose without written permission from the applicable owner. All rights not expressly granted are reserved.
If you send us comments or suggestions about the Site, you allow us to use them without restriction or compensation. Do not send information you consider confidential through a feedback message unless we have agreed in writing to receive it confidentially.
Privacy
Our Privacy Policy explains the information we collect through the Site, how we use and share it, and the choices available to you. It is incorporated into these Terms by reference.
Third-party services and links
The Site links to client websites, social platforms, analytics services, and other third-party websites or services. We do not control those third parties and are not responsible for their content, availability, security, or privacy practices. A link does not necessarily mean Anvil endorses everything on the destination site. Your use of a third-party service is governed by that service's own terms and policies.
Disclaimers
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, Anvil disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will always be available, accurate, secure, or free of errors or harmful components.
Case studies describe particular projects and circumstances. Results vary, and nothing on the Site guarantees that another project will produce the same result. Site content is general information, not legal, tax, accounting, or other professional advice.
Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Anvil and its members, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to the Site or these Terms.
To the fullest extent permitted by law, Anvil's total liability for all claims arising from or related to the Site or these Terms will not exceed the greater of $50 or the amount you paid Anvil specifically for use of the Site during the six months before the event giving rise to the claim. Limits in a separate client agreement apply to services performed under that agreement.
Some jurisdictions do not allow certain liability limits, so part of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Anvil and its members, employees, and contractors from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, your material violation of these Terms, or your violation of another person's rights. We may control the defense of a covered claim, and you agree to cooperate reasonably with that defense.
Suspension and termination
We may restrict or terminate your access to the Site if we reasonably believe you have violated these Terms, created risk for Anvil or another person, or used the Site unlawfully. Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, liability limits, indemnification, and governing-law provisions.
Governing law
These Terms and disputes arising from the Site are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules. Unless applicable law requires otherwise, the state and federal courts serving Jones County, Mississippi will have exclusive jurisdiction over disputes arising from the Site or these Terms, and you consent to their jurisdiction.
Either party may bring an eligible individual claim in small claims court or seek appropriate injunctive relief to protect intellectual-property rights.
General terms
We may revise these Terms by posting an updated version on this page and changing the effective date. Your continued use of the Site after revised Terms take effect means you accept them.
These Terms and the Privacy Policy are the entire agreement between you and Anvil concerning use of the public Site. If a provision is invalid or unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, or sale of the business.
